Terms & Conditions

These Terms govern purchases made through www.appytoys.com.mt and explain the main rules that apply between APPYTOYS and its customers.

Important: These Terms do not exclude or restrict any mandatory consumer rights that apply under Maltese or other applicable consumer law.

Seller and scope

The seller is Theia Moira Ltd, trading as APPYTOYS, with registered address at Triq Il-Kullegg L'Antik, Tas-Sliema SLM 1379, Malta, VAT number MT 2168-2832. These Terms apply to sales concluded through www.appytoys.com.mt.

Where a customer acts as a consumer, mandatory consumer protections remain fully applicable.

Eligibility and customer information

Customers must provide accurate, complete and up-to-date information when ordering. APPYTOYS may refuse or cancel an order where required by law, where payment cannot be authorised, where the product is unavailable, where the order is manifestly erroneous or fraudulent, or where information necessary to fulfil the order is missing or inaccurate.

Customer accounts

APPYTOYS uses passwordless customer accounts. Customers sign in with their email address and a temporary verification code. Verification codes are confidential and should not be shared with anyone.

Orders and electronic contracting

Products, quantities, prices, delivery information and other relevant details are displayed during the electronic checkout. After an order is submitted, APPYTOYS provides an electronic order confirmation. Acceptance remains subject to payment authorisation, product availability and the checks reasonably required to process the order.

If APPYTOYS cannot accept or fulfil an order, the customer will be informed and any amount due back will be handled through the original payment route or another lawful method.

Product information and availability

APPYTOYS seeks to keep product descriptions, images, availability and specifications accurate. Manufacturer packaging, graphics or minor presentation details can change without altering the essential product. Where an error materially affects an order, APPYTOYS will contact the customer as appropriate.

Inventory is dynamic and a product can become unavailable between browsing and final order processing.

Prices, taxes, promotions and Gift Cards

The price shown at checkout is the price applicable to the order, subject to correction of obvious errors. Taxes, shipping and other charges are shown according to the market and checkout configuration.

Promotional codes and Gift Cards are subject to their stated conditions, including eligibility, expiry, minimum spend, market restrictions and combination rules. A promotional code that is not applied before the order is completed cannot be assumed to be applied retroactively.

Payment

The payment methods currently available are those displayed at checkout. Payment may be processed by third-party payment providers. APPYTOYS does not require customers to send full payment-card details to Customer Care.

Where authentication is required by the payment provider or applicable payment rules, the customer must complete that authentication before payment can be accepted.

Shipping and delivery

Current delivery methods, indicative transit times and shipping charges are published in the Shipping Policy & Rates and confirmed at checkout. APPYTOYS may fulfil an order from more than one logistics location and may divide it into multiple shipments.

Risk in goods passes to a consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession, subject to applicable law.

Order changes and cancellation before fulfilment

Customers should contact APPYTOYS immediately if they need to correct an address, quantity or other order detail. Changes cannot be guaranteed once payment, inventory allocation, fulfilment or carrier processing has begun.

Where supported and the order status allows it, an unfulfilled item may be submitted for cancellation. See Order Changes & Cancellations.

Right of withdrawal and standard returns

Consumers may exercise the statutory right of withdrawal within the applicable 14-day period. After communicating the decision to withdraw, eligible goods must be sent back without undue delay and within the further statutory return period.

For a standard withdrawal, the customer bears the direct cost of returning the goods where the customer has been informed of that obligation. APPYTOYS requires customers to wait for the authorised return instructions and to use the logistics centre specified for the return.

The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Statutory exclusions from the right of withdrawal continue to apply where applicable.

Damaged, defective or non-conforming goods

Product faults, transport damage, incorrect items and other conformity issues are handled separately from a standard change-of-mind return. Customers should contact APPYTOYS before sending anything back and provide the information reasonably necessary to review the case.

Where the legal guarantee applies, the remedies required by applicable consumer law remain available, including repair or replacement where appropriate and, in the circumstances provided by law, price reduction or termination.

Refunds

Refunds are handled in accordance with applicable law, the reason for the refund and the original payment method. For statutory withdrawal, APPYTOYS may withhold reimbursement until the goods are received or the customer supplies evidence of having sent them back, where permitted by law.

Any lawful deduction for diminished value, premium delivery choices or other amounts must be handled in accordance with applicable consumer law.

Use of the website and intellectual property

The APPYTOYS website, branding, original text, graphics, layout and other protected material may not be copied, reproduced or exploited except as permitted by law or with appropriate permission. Third-party trademarks and product materials remain the property of their respective owners.

Liability and events outside reasonable control

Nothing in these Terms excludes liability or rights that cannot lawfully be excluded. APPYTOYS is not responsible for delay or failure caused by events outside its reasonable control to the extent permitted by law, but will take reasonable steps to communicate material disruptions and fulfil its legal obligations.

Governing law and consumer jurisdiction

These Terms are governed by the laws of Malta, without depriving consumers of mandatory protections that apply to them under applicable law. Any jurisdiction clause is subject to mandatory consumer-protection and private-international-law rules.

Questions, complaints and requests can be submitted through Contact APPYTOYS. Include the order number and the relevant product, payment or tracking information where appropriate.

The version of these Terms in force when the order is placed applies to that purchase, subject to mandatory law.
